Bettina: from meme to investigated by Procon

Empiricus has up to 48 hours to prove Bettina's assets of more than BRL 1 million

In the last few weeks, the meme of Bettina has been spreading through the internet and social networks from an advertisement made by the company Empiricus. The repercussion, however, went beyond the viral nature and became legal. O Procon de São Paulo notified the company, requesting clarification regarding the advertising piece and that it prove the veracity of the facts shared by the girl.

Who is Bettina?

A few days ago, a video started to go viral on the internet, having a high repercussion and becoming one of the memes published by Brazilians. In it, a young woman named Bettina says he is 22 years old and has an accumulated net worth of more than R$ 1 million, all from an investment of R$ 1.520,00.

The almost surreal content with which the information is passed turned out to be comical for many internet users. The original video is no longer available on Youtube, but there are copies scattered across the platform. Check out:

That's why, like many things here in Brazil, they wasted no time in creating an infinity of memes about Bettina.

But in addition to fun, the video also brought another kind of repercussion. O Procon de SP entered history by subpoenaing the company responsible for it, the Empiricus. The consumer protection foundation published a note explaining the purpose of the subpoena.

In it, he explains that this request for clarification requires that the Empiricus, pursuant to article 36 of the CDC, make a clarification to confirm whether the video in question, which is being widely disseminated, is in fact an advertising piece or not.

They also require the company to present documents that can prove what is said in the video. In other words, a document that shows a real financial evolution and accompanied by Bettina, which in this case is placed as an actress or deponent in the case.

A Empiricus You have 48 hours to comply with these requirements. In addition to Procon, another organ is also eyeing the video. O National Advertising Self-Regulation Council (Conar) stated that he is also aware of what is happening and will take action on what happened. That's because many internet users are complaining about the marketing piece on YouTube.

A Empiricus is doing everything to ensure that its marketing pieces have the necessary disclosure and everyone's attention. In 2018, the
Securities and Exchange Commission (CVM), overturned an injunction that prohibited it from carrying out a more thorough inspection of the videos and advertisements broadcast by the company.

In the same year, Philip Miranda, the executive director of Empiricus, he said in an interview with Globe, that they do not respect the GVC as a regulatory body for its texts. He also said that he didn't care if the commission didn't like the tone of his advertisements, but that it was not their business but a problem for the Procon or the conar.

Felipe he also added that if his client feels injured in any way, he should look for one of these organs.

Well, that's what's happening now. Regarding this case, the GVC stated that he does not comment on specific situations, but that he is always following everything that involves the securities market. That is, they are aware of what happened, although they have not yet registered anything against the piece in question.

Even so, there are about 15 administrative proceedings in the preliminary stage opened by the GVC against a Empiricus, all stemming from investor complaints. That's because the company seems to bet on more aggressive marketing, promising things like 41% profit in 40 days.
